More than a million houses in the U.S. have rooftop solar panels. Selling and buying one of these homes carries legal risks.
One area of concern is properly transferring ownership of the panels in the transaction. Contract forms for the sale and purchase of a house are often provided by a local board of realtors and those forms do not adequately address the evolving issues arising from a sale of a home with rooftop solar panels. The business terms of PV installation including ownership of the panels varies from one transaction type to another. Typically, the terms are governed by varying state laws.
